   An act relating to hazardous materials, making an appropriation
therefor, and declaring the urgency thereof, to take effect
immediately.



	LEGISLATIVE COUNSEL'S DIGEST


   SB 274, Johannessen.  Hazardous materials:  Shasta Cascade
Hazardous Materials Response Team.
   Existing law provides for the regulation of hazardous waste under
the hazardous waste control laws by the Department of Toxic
Substances Control and specified local agencies.
   This bill would appropriate $140,000 from the Toxic Substances
Control Account to the Department of Toxic Substances Control for
allocation to the County of Shasta for the purchase of emergency
response equipment for the Shasta Cascade Hazardous Materials
Response Team.
   The bill would prohibit the County of Shasta from expending more
than 1% of the appropriation for administrative expenses.
   The bill would declare that it is to take effect immediately as an
urgency statute.
   Appropriation:  yes.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  (a) The sum of one hundred forty thousand dollars
($140,000) is hereby appropriated for expenditure, notwithstanding
Section 13340 of the Government Code, without regard to fiscal year,
from the Toxic Substances Control Account to the Department of Toxic
Substances Control for allocation to the County of Shasta for the
purchase of emergency response equipment for the Shasta Cascade
Hazardous Materials Response Team.
   (b) The County of Shasta shall expend not more than 1 percent of
the appropriation made in subdivision (a) to pay for the
administrative costs of purchasing emergency response equipment for
the Shasta Cascade Hazardous Materials Response Team.
  SEC. 2.  This act is an urgency statute necessary for the immediate
preservation of the public peace, health, or safety within the
meaning of Article IV of the Constitution and shall go into immediate
effect.  The facts constituting the necessity are:
   So that the Shasta Cascade Hazardous Materials Response Team may
receive adequate funding to carry out emergency response to hazardous
materials accidents and releases in the seven northern counties of
Emergency Planning District III, it is necessary that this act take
effect immediately.
